1 Acceptance

By downloading, installing, or using Toolmatic (the "App"), you agree to these Terms of Use and to Apple's Licensed Application End User License Agreement, which governs all software distributed through the Mac App Store. If you do not agree, do not install the App, and delete any copy you may already have.

2 Licence to use Toolmatic

Subject to these terms, you are granted a personal, non-transferable, non-exclusive licence to install and use the App on any Mac that you own or control and that is signed in to your Apple ID, consistent with the usage rules set out in Apple's Media Services Terms. Family Sharing is supported for the Lifetime unlock in-app purchase in regions where Apple supports it.

3 Toolmatic Pro subscription

Toolmatic Pro is an auto-renewing subscription sold at US $4.99 per month. Equivalent prices in other currencies are shown in the App Store before confirmation. Payment is charged to your Apple ID on confirmation of the purchase. Your subscription automatically renews at the end of each monthly period unless you cancel it at least 24 hours before the renewal date. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the same price, unless the price has changed and you have been notified in advance in accordance with App Store rules.

You can manage, upgrade, downgrade, or cancel your subscription at any time from your device by opening System Settings, your name, Media and Purchases, Subscriptions, or through your Apple ID at apps.apple.com/account/subscriptions. Cancelling takes effect at the end of the current paid period; you will not be refunded for the balance of that period, and you retain Pro access until it expires.

4 Lifetime unlock in-app purchase

Lifetime unlock is a non-consumable in-app purchase sold at US $24.99 (equivalent local prices apply). It grants you permanent access to the features available in Toolmatic at the time of purchase, and to all future improvements to those features. Major new categories of functionality, if they are ever introduced, may be offered as separate purchases; in practice, ongoing improvements to existing tools and support for new formats within them are always included. The Lifetime unlock can be restored on any Mac signed in with the same Apple ID from the App's settings screen, and is eligible for Family Sharing.

5 Refunds and cancellation

All purchases, subscriptions and in-app purchases, are handled by Apple. Refund requests are therefore submitted to Apple at reportaproblem.apple.com. Apple makes the final decision on refunds. If you believe a charge was in error or the App did not function for you, we encourage you to write to us at [email protected] first, so we can help you resolve the underlying problem or advocate for your refund where appropriate.

6 Your content and acceptable use

You retain all rights to files you process with the App. We do not claim any licence or ownership over your content; we cannot, in any event, since your files never leave your Mac. You agree to use the App only for lawful purposes and not to use it to infringe the intellectual-property rights of others, create malware, or violate applicable law. You are solely responsible for confirming that your use of a tool, particularly format conversion, watermark removal, or downloading, is lawful in your jurisdiction.

7 Use of the downloader

The built-in downloader is intended for personal use with content you have the right to download, such as your own uploads, public-domain works, Creative-Commons-licensed material, or material the rights-holder has expressly permitted you to download. Many popular streaming services prohibit downloading in their terms of service; downloading from those services may violate those terms even where it is not itself illegal. It is your responsibility to respect the terms of the services you connect to and the rights of the creators whose work you save.

8 Updates and availability

We may issue updates to the App to add features, fix bugs, and maintain compatibility with new versions of macOS. Updates are distributed through the Mac App Store and are subject to its delivery mechanism. We do not guarantee that every past feature will remain available indefinitely; where a feature is removed or significantly changed, we will note the change in release notes. Compatibility with a given macOS version is stated on the App's Mac App Store page.

9 Intellectual property

The App, including its name, icon, wordmark, user interface, source code, and accompanying documentation, is owned by us and is protected by copyright, trademark, and other intellectual-property laws. These terms grant you a licence to use the App, not any rights in the App itself, except as expressly stated here or in Apple's End User License Agreement. Third-party components are used under their respective licences, which are available on request.

10 Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or suitable for any particular use, or that any data you process will be preserved without corruption. Always keep backups of important files before running any conversion, compression, or batch operation.

11 Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability to you for all claims arising out of or relating to the App or these terms shall not exceed the greater of (a) the amount you have paid to Apple for the App and its in-app purchases in the twelve months preceding the claim, and (b) five US dollars. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

12 Governing law

These terms are governed by the laws of the jurisdiction in which the App publisher is established, without regard to conflict-of-laws rules. Where applicable mandatory consumer-protection laws in your country of residence grant you additional rights, those rights are not affected by this clause.

13 Changes to these terms

We may revise these terms from time to time. The revised version takes effect when it is posted on this page, and we will update the date at the top accordingly. Your continued use of the App after a revised version is posted constitutes acceptance of the revised terms. Where a revision materially reduces your rights, we will make reasonable efforts to notify you inside the App before the change takes effect.
